TERMS AND CONDITIONS FOR POSTING PRODUCT REVIEWS

§1. General provisions

1. The Terms and Conditions set out the principles for the electronic provision of a service that allows Users to post reviews of products offered in the MILITARY online store, available at: https://military.eu ("Store").
2. The Service Provider and owner of the Store is FHTM sp. z o.o., registered in the register of entrepreneurs kept by the District Court for Wrocław Fabryczna in Wrocław, VI Economic Department of the National Court Register under KRS number: 0001007605, NIP: 8971750736, REGON: 020921807, place of business and address for delivery: ul. Graniczna 8C, 54-610 Wrocław, electronic mail address (e-mail): contact@military.eu, tel. +48 71 347 47 00. ("Service Provider").
3. The Terms and Conditions are made available free of charge on the Store's website in a way that allows it to be obtained, reproduced, and recorded.
4. The review posting service is an electronically provided service and is free of charge.
5. Every User, before using the form for adding reviews, is obliged to read the Terms and Conditions and comply with its provisions.

§2. Definitions

The terms used in the Terms and Conditions mean:

1. User – an individual using the feedback form available in the Store.
2. Product – a movable item available in the Store or a service that is the subject of a review.
3. Review – User's subjective statement regarding the Product, posted via the feedback form, which consists of at least 150 characters.
4. Rating – the number of stars assigned to the Product by the User on a scale from 1 to 5, where 1 is the lowest rating and 5 is the highest rating.
5. Photo – a photo added by the User along with the Review.
6. Video – YouTube video to which the User provided a link.
7. User Content – Review, Rating, Photo, Video, caption and other content provided by the User in connection with the use of the service.

§3. Technical conditions for use of the service

1. In order to use the review posting service the following is required:
   1. a device with access to the Internet,
   2. a current web browser that supports cookies and JavaScript,
   3. an active e-mail address.
2. The Service Provider takes measures to ensure the correct operation of the review form, subject to technical interruptions, failures, and events beyond the Service Provider's control.
3. The User is obliged to use the service in a manner consistent with the law, common decency, and the Terms and Conditions.

§4. Conclusion and termination of the service agreement

1. The contract for service electronic provision consisting in enabling the addition of a Review shall be concluded as soon as the User starts using the Review form.
2. The contract is executed and terminates upon:
   1. successful submission of the Review by the User and completion of the moderation process, or
   2. resignation by the User from adding the Review before its submission.
3. The Service Provider may prevent the use of the service or remove User Content in cases provided for in the Terms and Conditions or by law.
4. Termination of the service contract does not affect the rights acquired by the Service Provider under the license granted in accordance with §8 of the Terms and Conditions.

§5. Rules for addition of reviews

1. The User may add a Review of the Product using the form available in the Store.
2. The Review includes:
   1. textual content (mandatory),
   2. Rating on a scale of 1-5 (mandatory),
   3. User's signature (mandatory),
   4. one or more Photos (optional),
   5. Video (optional).
3. The Review should relate to the Product to which the product card applies and present a fair, understandable and lawful position of the User.
4. Photos added to Reviews should be related to the Product or to the way it is used or presented.
5. The Service Provider moderates Reviews, Photos and Videos before they are published.
6. The Service Provider verifies that the User who adds a Review has actually purchased the Product from the Store.
7. Verification is done by automatically searching the Store to see if there is a finalized order with the Product to which the Review is added to a given email address.
8. Reviews that successfully pass verification are marked "Review confirmed by purchase".
9. The Service Provider does not verify whether the User who adds a Review has used the Product.
10. The Service Provider does not automatically publish all submitted Reviews. Only User Content that complies with the Terms and Conditions and legal regulations is published.
11. Moderation is carried out according to the criteria specified in the Terms and Conditions, regardless of whether a Review is positive, neutral, or negative.

§6. Prohibited content

1. It is prohibited to post User Content:
   1. that is illegal,
   2. that violates the rules of social coexistence, public decency or the rights of third parties,
   3. that is vulgar, offensive, defamatory, discriminatory or inciting violence, hatred or committing a criminal act,
   4. that violates personal rights, privacy, image, business secrets, copyrights, related rights, industrial property rights or other rights of third parties,
   5. that contains personal data of third parties without a legal basis for their disclosure,
   6. that is advertising, promotional, spam or contains links to other sites or stores,
   7. that is unrelated to the Product,
   8. that is misleading regarding the features, quality, origin or use of the Product,
   9. that contains malicious software or elements that may interfere with the operation of information and communication systems,
   10. that is de facto a complaint submission.
2. It is prohibited to add Photos or Videos:
   1. that are not the User's own material or material to which the User has the relevant rights or consents,
   2. that depict third parties without the required permission to distribute their images,
   3. that depict indecent, illegal content or violating the rights of third parties.
3. Reviews, Photos or Videos must be free of legal defects.

§7. User statements

1. By submitting a Review, Photo or Video, the User states that:
   1. is the author of the User Content or has the right to use and dispose of it to the extent necessary to post it and to grant a license under the terms of the Terms and Conditions,
   2. the User Content is free from legal defects and claims of third parties,
   3. the User Content does not violate the law, rules of social coexistence, good customs or rights of third parties,
   4. if the Photo presents the image of a third party, the User has the consent of that person to distribute the image to the extent of the Terms and Conditions, or there is another legal basis allowing its distribution,
   5. the User Content provided is truthful to the extent that it relates to the User's experiences, observations or assessments.
2. The User is responsible for the User Content published through the Store.

§8. Copyright and license

1. Upon submission of a Review or a Photo, the User grants the Service Provider a free, non-exclusive, territorially unlimited license to use the User's Content constituting works within the meaning of the Copyright and Related Rights Act.

3. The license is granted for an indefinite period of time and covers the following fields of exploitation:
   1. recording and reproduction of User Content by any technique, especially digital,
   2. entering into the memory of a computer, servers, databases, information systems, clouds and other ICT systems of the Service Provider,
   3. making User Content available to the public in such a way that anyone can access it at a place and time of their choosing, in particular on the Internet,
   4. public display of User Content on the Service Provider's websites and mobile applications,
   5. publishing User Content on the Store's website, on Product pages, in review sections, listings, rankings, recommendation modules and in other online stores belonging to the Service Provider,
   6. making technical adjustments necessary for the publication or presentation of User Content, in particular cropping, scaling, compression, changing the file format, technical correction, anonymization, deletion of personal data, correction of obvious language errors and preparation of abbreviated versions, as long as this does not lead to a change in the meaning of the Review or the assigned Rating,
   7. translation of User Content into other language versions used in the Service Provider's online stores,
   8. combining User Content with other content, graphic elements, descriptions of Products or technical materials of the Service Provider.
4. The User agrees that the Service Provider may execute dependent rights to the User's Content only to the extent necessary for the activities indicated in paragraph 2.
5. The Service Provider may distribute User Content:
   1. using the User's signature,
   2. anonymously.
6. The license also includes the right to use the User Content by the Service Provider on all online stores, sales platforms and websites owned or operated by the Service Provider.
7. The license is granted free of charge. The User is not entitled to remuneration for the use by the Service Provider of the Reviews, Photos or Video within the limits of the Terms and Conditions.
8. In the case of User Content that does not constitute a work, the provisions of this paragraph shall apply accordingly to the fullest extent permitted by law.

§9. Moderation, refusal to publish and removal of reviews

1. The Service Provider reserves the right to:
   1. refusal to publish a Review, Photo or Video,
   2. temporary suspension of publication,
   3. remove a published Review, Photo or Video,
   if there is a justified suspicion of a violation of the Terms and Conditions, the law, or the rights of third parties.
2. In particular, the Service Provider may refuse to publish or remove User Content when:
   1. it is in violation with §6 or §7 of the Terms and Conditions,
   2. there are doubts about the legality of its origin or the scope of the User's rights,
   3. it contains personal data, image or other information about third parties without the required legal basis,
   4. its publication could expose the Service Provider or third parties to legal liability,
   5. a credible objection to its unlawful nature has been raised.
3. The Service Provider may make non-substantive editorial or technical changes to the User Content, in particular, remove obvious errors, excess characters, personal data, advertising content or elements that interfere with the presentation of the Review, provided that this does not change the meaning of the Review or the assigned Rating.
4. The Service Provider is not obliged to publish every submitted Review or every submitted Photo.
5. The Service Provider may also remove the Review or Photo after their publication if it obtains credible knowledge of their unlawful nature.

§10. Complaints regarding the service

1. The User may file complaints about the operation of the review posting service, moderation, refusal to publish or removal of User Content.
2. The Complaint should include at least:
   1. details identifying the User,
   2. description of the case,
   3. indication of the Product or Review to which the complaint relates,
   4. the User's request.
3. Complaints can be filed:
   1. electronically to: contact@military.eu, or
   2. in writing to the address of the Store's registered office.
4. The Service Provider shall consider the complaint within 14 days of receipt.
5. The Service Provider will inform the User about the manner in which the complaint will be considered, either at the e-mail address or at the mailing address provided in the complaint.

§11. Personal data

1. Personal data of Users is processed by the Service Provider in accordance with the applicable regulations on personal data protection.
2. Detailed information on the processing of personal data can be found in the Privacy Policy of the Store available at: https://military.eu/faq/privacy-policy.
3. In the content of the Review, in the Photos or in the Video, the User should refrain from including personal data, the disclosure of which is not necessary.

§12. Final provisions

1. The Terms and Conditions come into effect on 07.07.2026.
2. In matters not regulated by the Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code, the Act on Rendering Electronic Services, the Act on Copyright and Related Rights and the Act on Counteracting Unfair Market Practices.
3. The Terms and Conditions may be amended for important reasons, in particular in case of changes in the law, changes in the functionality of the feedback form or changes in the data of the Service Provider.
4. Amendments to the Terms and Conditions do not affect the rights acquired before the date of their entry into force.
